Terms & Conditions (Terms of Service)

Welcome to JD Boost (“JD Boost,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website and any related pages, content, tools, and services (collectively, the “Site” and “Services”) available at http://jdboost.co.

By accessing or using the Site and/or Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.

1) Who we are / What we provide

JD Boost provides marketing and growth services, which may include AI-powered lead generation, review/reputation management, multi-channel marketing automation, real-time analytics, and strategy services (the “Services”).

2) Privacy Policy

Your use of the Site is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, and share information (including via comments, cookies, and embedded content). If these Terms conflict with the Privacy Policy on a data-handling issue, the Privacy Policy controls.

3) Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Services. By using the Site, you represent you meet this requirement.

4) No professional advice

Information on the Site is provided for general informational purposes only and is not legal, financial, medical, or other professional advice. You are responsible for obtaining appropriate professional advice for your specific situation.

5) Accounts, forms, and communications

If you submit a form, request a quote, subscribe, or otherwise provide information, you agree that:

  • the information you provide is accurate and up to date, and

  • we may contact you using the details you provide (e.g., email/phone) to respond to your inquiry and provide Services, consistent with the Privacy Policy.

6) Client responsibilities (when engaging Services)

When you purchase or engage Services from JD Boost, you agree to:

  • provide timely access to required assets (logos, brand guidelines, ad accounts, analytics access, website/admin access, etc.);

  • respond to requests for approvals/feedback within a reasonable time;

  • ensure you have rights to use any content you supply (images, videos, trademarks, customer lists, etc.);

  • comply with all applicable laws and platform policies (e.g., Google/Meta terms, email/SMS marketing rules, and ad policies).

7) Payments, fees, and refunds

If you purchase Services:

  • fees, billing terms, and scope (deliverables, timeline, payment schedule) will be defined in a proposal, invoice, statement of work (SOW), or written agreement (the “Order Terms”).

  • unless required by law or explicitly stated in the Order Terms, payments are non-refundable once work has started or access/licenses/subscriptions have been provisioned.

  • you are responsible for third-party costs (ad spend, software subscriptions, hosting, domain, etc.) unless explicitly included in writing.

8) Third-party services and links

The Site and Services may reference or integrate third-party tools (e.g., analytics, CRMs, video embeds, payment processors, social media platforms). We do not control third-party services and are not responsible for their content, policies, or performance. Your use of third-party services is at your own risk and subject to their terms.

9) Comments and user-generated content

If you leave comments or submit content on the Site:

  • you grant us a non-exclusive, worldwide, royalty-free license to display and use that content for operating the Site;

  • you agree not to post unlawful, defamatory, harassing, infringing, or misleading content;

  • we may remove or moderate content at any time for any reason.

Spam detection, IP logging, and related handling are described in the Privacy Policy.

10) Intellectual property

All Site content (text, graphics, logos, design, templates, and other materials) is owned by or licensed to JD Boost and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

Client work product: Unless your Order Terms state otherwise, final deliverables you’ve paid for are licensed or transferred to you for your business use, while JD Boost retains rights to pre-existing materials, frameworks, know-how, and reusable components.

11) Acceptable use

You agree not to:

  • use the Site/Services for illegal, fraudulent, or harmful activities;

  • attempt to gain unauthorized access to systems/accounts;

  • interfere with Site operation (malware, scraping, DDoS, etc.);

  • violate others’ privacy or intellectual property rights.

12) Disclaimers

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, JD BOOST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee specific outcomes (e.g., rankings, revenue, lead volume, ad performance), because results depend on many factors outside our control.

13) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JD BOOST WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JD BOOST’S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID JD BOOST FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE 3 MONTHS BEFORE THE EVENT THAT CAUSED THE CLAIM (OR $100 IF YOU HAVE NOT PAID JD BOOST FOR SERVICES).

14) Indemnification

You agree to defend, indemnify, and hold harmless JD Boost from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site/Services, your violation of these Terms, or your infringement of any third-party rights.

15) Termination

We may suspend or terminate access to the Site/Services at any time if we reasonably believe you violated these Terms or if required to protect the Site, our users, or third parties. Provisions that should survive termination (e.g., IP, disclaimers, limitation of liability, indemnity) will survive.

16) Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will reflect the latest version. Continued use of the Site after changes means you accept the updated Terms.

17) Governing law

These Terms are governed by the laws of the jurisdiction where JD Boost operates, without regard to conflict of law principles. If you want this to be specific (e.g., Texas), set it to match your business registration and/or contract templates.
